1. About these terms

These terms govern use of the Ty’s Menswear website and purchases made through it. Ty’s Menswear is operated by Square Deals Pty Ltd. “Ty’s”, “we”, “us” and “our” refer to Square Deals Pty Ltd trading as Ty’s Menswear.

By using the website or placing an order, you agree to these terms together with the Privacy Policy, Shipping & Returns Policy and any additional conditions clearly shown before purchase.

2. Website eligibility and acceptable use

You must be legally able to enter into the transaction or use the website with the involvement of a parent, guardian or authorised person.

You must not:

• Use the website unlawfully, fraudulently or in a way that harms Ty’s or another person
• Attempt to gain unauthorised access to accounts, systems or data
• Introduce malicious code, scrape the website excessively or interfere with its operation
• Use false identity, payment, billing or delivery information
• Reproduce website content commercially without permission

3. Products, images and descriptions

We aim to describe products accurately, but colours may appear differently because of lighting, screen settings and production variation. Dimensions may be approximate and materials may vary between products.

Product photographs may include styling items that are not included. The product description and selected variant determine what is supplied.

We may correct errors, update descriptions or withdraw a product at any time. If a material error affects an existing order, we may contact you before fulfilment.

4. Prices, taxes and promotions

Prices are shown in the currency displayed on the website. Taxes, duties, delivery charges and other amounts will be shown where applicable before the order is completed.

Promotions, discount codes, free gifts and multi-buy offers may have separate eligibility rules, dates, exclusions and stock limits. Unless stated otherwise:

• Promotions cannot be combined
• Only one discount code may be used per order
• Free gifts have no cash alternative
• Returns may affect promotional eligibility or the refund amount
• Obvious pricing or promotional errors may be corrected

5. Orders and acceptance

Submitting an order is an offer to purchase. An automatic confirmation confirms that we received the order; it does not necessarily mean the order has been accepted.

We may decline or cancel an order before fulfilment where reasonably necessary, including for:

• Stock or supplier unavailability
• An obvious pricing, product or promotional error
• Payment failure or suspected fraud
• An invalid or undeliverable address
• Unusual quantities suggesting unauthorised resale
• A legal, sanctions, safety or compliance issue

If we cancel an order after payment, the relevant amount will be refunded.

6. Payment and fraud checks

Payment is processed by third-party payment providers. You confirm that you are authorised to use the selected payment method and that the supplied information is accurate.

Orders may be subject to automated or manual fraud screening. We may request further verification, delay fulfilment while checks are completed or cancel an order where risk cannot reasonably be resolved.

Ty’s does not normally receive or store your complete payment-card number.

7. Fulfilment and delivery

Ty’s may use third-party suppliers, warehouses and fulfilment partners. Products within one order may be dispatched separately and may arrive at different times.

Processing and delivery dates are estimates rather than guarantees. Delays may result from carrier operations, customs, severe weather, public holidays, high demand, incorrect addresses or events beyond reasonable control.

You are responsible for checking the delivery address before ordering. Contact us immediately if a change is required, but a change cannot be guaranteed after fulfilment begins.

Risk of loss generally passes when the parcel is delivered to the address, recipient or authorised safe location, subject to rights that cannot legally be excluded.

8. Cancellations, returns and refunds

Contact us immediately to request a cancellation or change. We will try to help, but orders cannot always be stopped once processing or fulfilment has started.

Returns and refunds are governed by the Shipping & Returns page. You must contact us before sending anything back and follow the supplied return instructions.

Returned products may be inspected. A change-of-mind refund may be refused or reduced where an item has been worn, washed, damaged, altered, used beyond reasonable inspection or returned without required components.

Nothing in these terms limits remedies for goods that are faulty, materially misdescribed or otherwise covered by mandatory consumer protections.

9. Customer accounts

You are responsible for protecting account credentials and for activity occurring through your account. Notify us promptly if you believe an account has been accessed without permission.

We may suspend or close an account where reasonably necessary to protect the customer, Ty’s, another person or the website.

10. Website content and intellectual property

The Ty’s name, logo, website design, original text, graphics and other original materials are owned by or licensed to us and are protected by applicable intellectual-property laws.

You may view and use the website for personal shopping. You may not copy, republish, sell, modify, systematically extract or commercially exploit content without permission, except where the law allows it.

Product names, photographs or marks belonging to third parties remain the property of their respective owners.

11. Disclaimers and liability

We do not guarantee that the website will always be uninterrupted, error-free or free from every security risk. We may suspend access for maintenance, security or operational reasons.

To the maximum extent permitted by law, Ty’s is not liable for indirect, incidental, consequential or special loss arising from website use, delayed delivery or a product, including loss of opportunity, profit or data.

Where liability cannot be excluded, it is limited only to the extent permitted by law. Nothing in these terms excludes liability or consumer rights that cannot lawfully be excluded.

12. General terms

If part of these terms is found unenforceable, the remaining parts continue to apply. Failure to enforce a provision immediately does not waive it.

We may update these terms when the website, business model, providers or legal requirements change. The version published when an order is placed generally applies to that purchase.

These terms are governed by the laws applicable to Square Deals Pty Ltd in Australia, while preserving any mandatory protections available to consumers in their place of residence.
